TERMS OF SALE – RACECAR AND CUSTOM ELECTRICAL LIMITED

Supplier Identity
These Terms of Sale apply to all goods supplied by Racecar And Custom Electrical Limited (“Supplier”), including goods sold under the trading name Race Shop, whether supplied directly or via the Supplier’s website or e-commerce platforms.

1. Application
These Terms apply to all goods supplied by the Supplier to the purchaser (“Customer”), including sales made directly and via online platforms.

2. Product Use Classification
All products are intended for off-road, motorsport, or competition use unless otherwise agreed in writing.
The Customer is responsible for determining the legality and suitability of the goods for their intended application.

3. Product Application
The Customer is solely responsible for determining the suitability of the goods for any specific vehicle, system, or use.
The Supplier makes no representation or warranty as to suitability for any particular purpose.

4. Installation and Integration
All goods must be installed and configured by a suitably qualified professional.
The Supplier accepts no responsibility for installation, integration, or system performance.
The Customer is responsible for ensuring appropriate safety measures and system protections are in place.

5. Compliance
The Customer is responsible for ensuring compliance with all applicable laws, regulations, and standards in the country of use.

6. On-Supply and Export
If the Customer resells, exports, or supplies the goods to any third party, the Customer assumes full responsibility for:
- Compliance with all applicable laws and regulations
- Product suitability and application
- Any claims, damages, or liabilities arising from such supply

The Supplier accepts no liability for goods supplied beyond the original Customer.

7. Limitation of Liability
To the maximum extent permitted by law, the Supplier’s liability is limited to the purchase price of the goods supplied.

The Supplier shall not be liable for:
- Indirect or consequential loss
- Loss of profit, revenue, or business
- Vehicle damage or mechanical failure
- Personal injury or death arising from use of the goods

This limitation applies only to the original Customer and not to any third party.

8. No Third-Party Reliance
No third party shall have any right to rely on the goods, specifications, or advice provided by the Supplier.

9. Warranty
Goods are supplied with a limited warranty covering manufacturing defects only.
This warranty does not cover:
- Incorrect installation
- External electrical faults
- Misuse, modification, or harsh operating conditions

10. Governing Law
These Terms are governed by the laws of New Zealand.
Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.

11. Updates to Terms
These Terms may be updated from time to time. The version in effect at the time of purchase applies to that sale.
